Terms of Service
The agreement between VoiceSync and the business using it.
What this covers
These terms govern your business's use of VoiceSync: an AI assistant that answers your telephone line, books appointments, captures orders and enquiries, and writes what it handled into your dashboard.
They are between VoiceSync and your business. They are not an agreement with the people who call you. Your obligations to callers are dealt with in the Data Processing Agreement.
What you are responsible for
You remain the business your customers are calling. That means:
- You are responsible for the accuracy of what you give the agent to say: your opening hours, prices, stock, and appointment availability.
- You are responsible for telling your customers that calls to your number may be answered by an automated assistant and transcribed. We give you wording for this; publishing it where your customers will see it is your obligation, because you are the one with the relationship to them.
- You must not use the service for marketing calls, automated outbound dialling, or any commercial communication to people who have not asked for it.
- You must not configure the agent to give medical, legal, financial or other regulated professional advice.
- You are responsible for the lawfulness of the data you put into the system, including having a basis to hold your customers' contact details.
What we do not do
The agent is a tool for handling routine calls. It is not a person, not a professional adviser, and not an emergency service.
- It does not give professional advice of any kind, and is configured to decline when asked.
- It cannot be relied on for emergencies. If a caller may be at risk, the agent directs them to seek immediate help and ends the call.
- It will sometimes mishear, misunderstand, or fail to complete a booking. You should check your dashboard rather than assume every call was handled correctly.
If your business depends on a call being answered a particular way, a human needs to be in that loop. Do not use this as your only channel for anything time-critical or safety-critical.
Availability
We aim to keep the service running continuously, but we do not promise uninterrupted availability. The service depends on telephone carriers, cloud providers and AI model providers we do not control, and any of them can fail.
We will tell you about planned maintenance where we reasonably can.
Fees and cancellation
Fees, billing period and notice are as agreed with you in writing. You may stop using the service at any time by pointing your telephone number away from it.
On termination we will, at your request, export your data to you and then delete it, subject to anything we are required to keep by law.
Liability
Nothing here limits liability that cannot lawfully be limited, including for death or personal injury caused by negligence, or for fraud.
Subject to that, we are not liable for lost profits, lost business, or losses arising from a call being missed, misunderstood, or wrongly handled, and our total liability is limited to the fees you paid in the twelve months before the claim.
Suspension
We may suspend the service if it is being used for outbound marketing, for unlawful purposes, to give regulated advice, or in a way that puts callers at risk. Where we can, we will tell you first and give you a chance to fix it.
Changes
We may update these terms. If a change materially affects you, we will tell you and ask you to accept the new version before you continue using the console. Your acceptance is recorded with the version and date.
